"Penta's Magic Pen" Terms of Service

These Terms of Service (the "Terms") set out the conditions for using the Android app "Penta's Magic Pen" (the "App"). By downloading or using the App, you are deemed to have agreed to these Terms.

1. License

The developer grants you a non-transferable, non-exclusive right to use the App for personal, non-commercial purposes in accordance with these Terms.

2. Prohibited Conduct

When using the App, you must not:

Copy, modify, decompile, or reverse engineer the App
Place an excessive load on the App or its servers, or attempt unauthorized access
Draw or transmit content that violates laws or public order and morals
Infringe the rights of third parties
Interfere with the operation of the App

3. Your Artwork

You own the copyright to the drawings you create in the App (your "Artwork"). Artwork is, in principle, stored only on your device. How Artwork data is handled when you use the AI judging feature is described in the Privacy Policy.

4. AI Judging

The AI verdicts (solved / not solved) and comments in the App are for entertainment purposes only, and their accuracy and consistency are not guaranteed. The developer accepts no responsibility for the content of verdicts or comments. The judging feature may be unavailable depending on network conditions.

5. Advertising

The App displays ads served by a third-party advertising provider (Google AdMob). The only ads in the App are rewarded ads that you choose to watch to recharge your pen magic.

The content of displayed ads is provided by the advertising provider and advertisers; the developer does not guarantee and is not responsible for it.
Ads may not be shown depending on network conditions or ad inventory.

6. In-App Purchases

The App offers a one-time in-app purchase ("Premium") with perks such as recharging the pen's magic without watching ads.

Purchases are processed through the Google Play billing system. Refunds are subject to the Google Play refund policy.
On devices used by children, we recommend enabling purchase authentication (parental controls) in Google Play.

7. Streaming and Video Sharing

Notwithstanding Section 1, posting gameplay videos, screenshots, and live streams of the App (including monetization through a platform's official features) is permitted within the scope of the separately published Streaming Guidelines. Please see the Streaming Guidelines for details.

8. Disclaimer

The App is provided "as is." The developer does not guarantee that the App will always operate correctly or be free of errors or defects.
To the extent permitted by law, the developer is not liable for any damage arising from your use of, or inability to use, the App.
The App may be changed, suspended, or discontinued without notice.

9. Changes to These Terms

The developer may change these Terms as necessary. The revised Terms take effect when posted on this page.

10. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Japan. Any dispute arising in connection with the App shall be subject to the exclusive jurisdiction of the court having jurisdiction over the developer's place of residence as the court of first instance.
